on

In a significant move to combat corruption and maladministration, President Cyril Ramaphosa has signed a proclamation authorizing the Special Investigating Unit (SIU) to probe seven controversial tenders awarded by the Mbombela Municipality. This investigation will focus on allegations of mismanagement, irregular expenditure, and potential violations of procurement regulations, with the aim of recovering any losses incurred by the state.

Tenders Under Investigation

The SIU investigation will cover several tenders issued by the Mbombela municipality between 2015 and 2023, including key projects related to housing development, engineering services, and municipal infrastructure. The tenders in question include:

  1. Tender PRE/040/14/MP: Legal services and investigations

  2. Tender DHS/112/15/MP: Installation of civil engineering services and construction of low-cost housing

  3. Tender NLM-TS-003/2015/16: Engineering services

  4. Construction-related goods and services for the R538 Hazyview to Numbi Gate project

  5. Bid 26/2015: Appointment of professional consultants for strategic support in municipal projects

  6. Bid 72/2017: Energy efficiency and demand-side management programme

  7. Tender 116/2018: Nsikazi North bulk water scheme phase 1 construction

The Scope of the SIU Probe

The SIU will investigate whether the procurement and contracting of these tenders were conducted in a fair, transparent, and cost-effective manner. Key areas under scrutiny include:

  • Irregular expenditure by the municipality or state

  • Misappropriation of funds received by the municipality

  • Non-compliance with national and provincial procurement guidelines, and Treasury regulations

  • Any unlawful conduct in the procurement process

The investigation will cover any acts of corruption, fraud, or maladministration that may have occurred from February 16, 2015, to May 2, 2025.

SIU’s Authority and Potential Legal Actions

Under the SIU Act, the Special Investigating Unit has the authority to take legal action against those found guilty of fraud, corruption, or maladministration. This may involve initiating civil suits in the High Court or the Special Tribunal to recover any state losses and hold wrongdoers accountable.

A Step Towards Transparency and Accountability

This investigation highlights the ongoing efforts by President Ramaphosa’s administration to address corruption and promote accountability within South Africa’s public sector. The SIU’s intervention comes at a time when the country is increasingly focused on reforming local government procurement processes and enhancing transparency in public service delivery.

The outcome of this investigation could set an important precedent in the fight against corruption, not only in Mbombela but across the entire South African public sector.

As the SIU begins its investigation into the Mbombela municipality, all eyes will be on the potential impact of this probe on the local government’s reputation and the future of public procurement practices in the country. While the investigation is ongoing, South Africans are hopeful that such measures will help root out wasteful spending and restore public trust in local governance.
