Ferrel Govender denied bail for fifth time as High Court rules against new-facts application

The Durban High Court refused Ferrel Govender’s fifth bail bid, ruling his relocation offer and tracking device proposal did not amount to exceptional circumstances.

The Durban High Court has refused a fifth bail application by Ferrel Govender, ruling that his proposed relocation and other offers did not amount to exceptional circumstances that would justify release.

Latest bid dismissed

The court dismissed Govender’s most recent application after he offered to pay R3 million, relocate to Sandton and wear a tracking device to address State concerns about interfering with witnesses. Judge Jacqueline Henriques found those measures did not “tip the scales in his favour as constituting exceptional circumstances which in the interests of justice warrant his release on bail.”

Charges and allegations

Govender, a former CEO of security company Pro Secure, faces 14 charges, including the murder of Durban businessman Shailen Singh and the attempted murder of Singh’s alleged lover, Salona Ramrutton/Kisten. The State alleges that Govender and his younger brother, Darren, killed Singh at Meridian Park in Umhlanga on December 29, 2024, after Govender allegedly discovered an affair.

Procedural history

Govender has previously been denied bail on multiple occasions. Magistrate K Bruorton refused bail on February 3, 2025, when both Govender and his brother applied; Darren was granted R200,000 bail. An appeal to the Durban High Court was dismissed by Judge Mfuniselwa Nkosi on March 20, 2025, and the Supreme Court of Appeal dismissed an application on May 15, 2025. A further magistrates’ court application based on new facts was refused on November 27, 2025.

Govender launched the latest new-facts bail application on May 28, 2026, shortly before the trial was due to begin on July 20, 2026. In his affidavit he argued that release would allow him to consult more freely with his legal team because he faces a possible life sentence.

Jurisdiction and recusal attempts

The application became complicated by a dispute over which court had jurisdiction to hear a second new-facts bail application. Henriques declared that “the High Court has exclusive jurisdiction to hear the applicant’s second bail application on new facts.”

Govender also sought the recusal of Magistrate Bruorton, alleging an after-the-fact conversation between Bruorton and Govender’s former attorney, Ravindra Maniklall, about a dossier found under Bruorton’s office door. The State opposed the recusal and argued that the claim was an attempt to review the earlier bail outcome. Henriques said the recusal application was based on untested hearsay: “It is correct that the recusal application is based solely on the applicant’s assertion and is premised on untested inadmissible hearsay evidence, which is not supported by any affidavits by the officers of the court or, interestingly enough, the applicant’s then representative, Maniklall.”

Next steps

The trial against Ferrel and Darren Govender will proceed in May 2027 before Judge Mbuzeni Mathenjwa.
