Sibiya rape accuser says she lives in constant fear as she opposes bail
An 18-year-old woman who has accused former police deputy commissioner Shadrack Sibiya of rape says she is living in constant fear and struggling with suicidal thoughts as she urges the court to deny him bail.
The state submitted her affidavit during Sibiya’s bail proceedings, asking the court to consider the impact the alleged offence has had on her and her concerns about his possible release.
In the affidavit, the woman said her fear had become overwhelming.
“Day in and day out, I am living in constant fear to the extent of being suicidal,” she stated.
She also told the court that she had discussed her concerns with a close friend over WhatsApp on 22 September, expressing fears that Sibiya could be granted bail.
Sibiya faces rape and human trafficking allegations
The state alleges that Sibiya raped the woman at a hotel in Sandton in May 2026 after she passed out due to intoxication.
He is also facing a human trafficking charge linked to alleged sexual exploitation in the same case.
Sibiya has denied the allegations, maintaining that his sexual encounter with the 18-year-old was consensual.
The charges remain allegations and have not been established as facts in court.
Separate case involves a 16-year-old girl
Sibiya is also facing charges in a separate matter involving a 16-year-old girl.
According to the state, the alleged conduct took place between July and August 2026 and involved sexual grooming and the promotion of the sexual grooming of a child.
The prosecution alleges that Sibiya communicated with the teenager through WhatsApp, requested explicit videos and instructed her to keep their conversations secret. He is also accused of possessing or sharing explicit images of the girl.
Sibiya has denied the allegations in this matter as well. He reportedly claims that the explicit material involving the teenager was sent to him by her father.
Bail hearing continues
The court must consider the information presented during the bail proceedings before deciding whether Sibiya should be released while the cases continue.
The 18-year-old’s affidavit forms part of the state’s submissions opposing bail, with her stated fears among the issues placed before the court.
The hearing is ongoing.
