Bail hearing for Oupa Brown Mogotsi postponed after alleged jail escape plot emerges

The Johannesburg Magistrates’ Court has postponed Oupa Brown Mogotsi’s application for bail on new facts after the State told the court that correctional authorities intercepted information about an alleged escape plan while he was in custody.

Postponement and reason given

Gauteng spokesperson for the National Prosecuting Authority, Magaboke Mohlatlole, said the matter was postponed to 1 September 2026 to allow the Department of Correctional Services to submit a detailed report to the court on the alleged plot.

What the court heard

During proceedings, the State informed the court that correctional officials had intercepted information suggesting that Mogotsi was planning to escape from custody and that steps were taken to prevent it. The prosecutor read into the court record an affidavit from the investigating officer stating he had been alerted by a Correctional Services official about the alleged plan.

Report to form part of evidence

The report from Correctional Services is expected to form part of the evidence when Mogotsi’s bail application on new facts resumes on 1 September 2026. The NPA said it would continue placing all relevant information before the court to ensure the matter proceeds in accordance with the law.

Charges and the underlying incident

Mogotsi, 45, faces several charges arising from an incident reported to police on 3 November 2025. According to the State, Mogotsi told police he had been driving alone in Vosloorus when occupants of a bakkie allegedly chased him and fired multiple shots at his vehicle, forcing him to stop before fleeing on foot.

The State alleges that Mogotsi fired 11 rounds at his own vehicle, and investigators recovered 11 spent cartridges at the scene. He faces charges of unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a built-up area, defeating or obstructing the administration of justice, and perjury.

Custody status

Mogotsi remains behind bars pending the continuation of his bail application on 1 September 2026.
