Limpopo man jailed for 22 years for raping 71-year-old neighbour

A Limpopo man has been sentenced to 22 years’ direct imprisonment for the rape of his 71-year-old neighbour. The Sibasa Regional Court delivered the sentence after hearing that the attack took place in 2019 inside the woman’s home.

What happened

The accused is a 59-year-old man who has not been identified in court proceedings to protect the victim’s identity. The court heard that, in 2019, the man observed the woman returning from a bus stop, followed her into her home, went to her bedroom, and a struggle ensued before he raped her.

Medical help and police action

After the incident the woman sought medical assistance at a nearby clinic and was referred to the Tshilidzini Thuthuzela Care Centre for further care and support. The matter was reported to police, which led to the man’s arrest and prosecution.

Trial and sentencing

During the trial the man pleaded not guilty to rape. State Prosecutor Muligi Mphedziseni Eric argued for the prescribed sentence of life imprisonment, submitting that the woman qualified as an older person under the Older Persons Act 13 of 2006 and that the attack occurred in the sanctity of her home. The prosecution emphasised the severe trauma suffered by the victim and said there were no substantial and compelling circumstances to justify a lesser sentence.

After considering the evidence and submissions, the court imposed a 22-year direct prison sentence. The court also ordered that the man’s name be entered into the National Register for Sex Offenders and declared him unfit to possess a firearm.
