Arthur Wheeler to appeal life sentences; NPA vows to oppose

A convicted child rapist and murderer, Arthur Wheeler is preparing to appeal his conviction and sentence, while the National Prosecuting Authority (NPA) has said it will oppose the application.

The Western Cape Division of the High Court in Cape Town sentenced Wheeler to two life terms and an additional 18 years’ direct imprisonment. The court formally imposed life imprisonment for the rape of a minor and life imprisonment for the child’s murder, and sentenced him to a further eight years’ direct imprisonment for sexual assault.

NPA response and prosecution work

NPA spokesperson Eric Ntabazalila said the authority will “vigorously oppose” Wheeler’s appeal application.

Ntabazalila named State Advocate Jarrod Seethal and investigating officer Charles Goodwin as key figures in the prosecution, saying they worked tirelessly to secure a successful outcome after handling two separate and complex matters against Wheeler.

Witness trauma and courtroom measures

Prosecutors faced challenges linked to the trauma of witnesses and the circumstantial nature of much of the evidence. An “extremely traumatised child witness” was required to testify, and the prosecution used measures to support that witness. Ntabazalila said an emotional support dog, Toffee Beanz, specially trained to assist vulnerable witnesses and reduce the stress associated with testifying, “was deployed to great effect during the proceedings.”

Details of the adult rape matter

In the adult rape matter, Wheeler was described as a mutual friend of the complainant who had previously expressed romantic interest in her. The complainant agreed to spend an evening out on 22 January 2005 with Wheeler and mutual friends on the understanding their relationship would remain platonic.

Ntabazalila said that while the complainant was “heavily intoxicated and separated from her friends,” Wheeler took advantage of her and took her to his home instead of her residence. The complainant lost consciousness on his couch and woke the next morning partially undressed with flashbacks of Wheeler being on top of her. Wheeler admitted they had engaged in sexual intercourse but claimed it was consensual.

Under cross-examination Wheeler acknowledged the complainant had confronted him the following morning and conceded that her inability to remember events was “indicative of her level of intoxication.” Ntabazalila said this evidence assisted the State in proving that the complainant was incapable of consenting due to extreme intoxication.

Child rape and murder case

The child rape and murder occurred during the weekend of 15 June 2023, when Wheeler arranged with the deceased child’s mother for the child, a friend of Wheeler’s son, to sleep over at Wheeler’s home. The child was expected to sleep on a bunk bed in Wheeler’s room, sharing with Wheeler’s son, while Wheeler would sleep on a separate double bed.

Witnesses testified the deceased was later found in Wheeler’s bed. The paramedic who first attended the scene observed unusual markings on the child’s neck, and DNA was recovered from Wheeler’s bed sheet. Post-mortem findings established the cause of death was consistent with asphyxia resulting from strangulation.

During the trial a child witness testified that he awoke during the night and observed Wheeler walking naked to the bathroom while the deceased was in Wheeler’s bed. Wheeler denied all allegations and could not explain how the child died while in his bed.

The court found that Wheeler had acted with direct intent to kill the child.

Sentencing remarks

In delivering sentence the court noted that Wheeler was a first offender but demonstrated no remorse, abused positions of trust in both matters, and failed to establish substantial and compelling circumstances that would justify a deviation from the prescribed minimum sentences.

What happens now

Wheeler is preparing an appeal against his conviction and sentence, and the NPA has signalled it will contest that application in court.
