Man from Ga-Mokgotho village jailed for 17 years for rape and robbery
A 23-year-old man from Ga-Mokgotho village has been sentenced to an effective 17 years in prison after being found guilty of rape and robbery with aggravating circumstances in Limpopo.
Conviction and sentence
The Burgersfort Regional Court found Clement Luwi Themishi Magabe guilty on 23 February and sentenced him on 29 June. The court imposed 17 years imprisonment for rape and an additional 10 years for robbery with aggravating circumstances, with the sentences running concurrently to result in an effective 17-year term.
The attack and arrest
The court heard the attack occurred on 26 August 2023 at about 11pm while a 32-year-old man was walking home. According to evidence presented, the accused attacked the victim from behind with a stone, causing him to fall, then robbed him of R900 in cash before raping him.
After the incident the victim returned home, informed his family and lodged a police complaint. Magabe was traced and arrested on 1 September 2023. The accused later appeared in court several times and was released on R1 000 bail while the case was finalised.
