Pretoria Court Rejects Plea from Accused Father of Three, Citing Risk to Public and Witnesses

It’s a case that gripped Gauteng and left South Africans reeling with anger, grief, and a shared sense of helplessness. The murder of five-year-old Ditebogo Phalane in May 2024 during a hijacking attempt sparked a wave of outrage, and now, one of the accused has been told in no uncertain terms: you’re not going home.

In the Pretoria North Magistrates’ Court this week, 35-year-old Elia Moeko’s bid for bail was firmly shut down. Charged with murder, aggravated robbery, possession of an unlicensed firearm and ammunition, and standing beside two co-accused, Ali Sithole and Nido Gumbe, Moeko had hoped the court would take pity on his role as a father and breadwinner.

But Magistrate Maseena Khan saw through the plea, calling out inconsistencies and potential threats to justice.

“He’s a Danger to Witnesses”

According to state prosecutor Advocate Tumelo Letaoana, Moeko conveniently left out a key detail in his bail affidavit: previous convictions. That, along with the risk of him fleeing or intimidating witnesses, made his case for release deeply unconvincing.

Testimony from investigating officer Sergeant Mashudu Savhasa painted Moeko as more than just a desperate dad. He was portrayed as someone with ties to a violent criminal case and no regard for the law. The court heard that not only did he omit his criminal past, but his co-accused had also already dropped their bail applications—perhaps knowing they stood little chance.

A Tragedy That Won’t Be Forgotten

South Africans remember May 10, 2024, not just as another day marked by violent crime, but as the day a family’s life was shattered. Little Ditebogo was gunned down in front of his father, Tebogo Phalane, during an attempted hijacking in Soshanguve. A botched car theft turned fatal and a child became collateral in a crime wave that continues to steal innocence from communities.

The suspects were later arrested on unrelated charges while in custody at Pretoria Moot Police Station, following an intensive probe by the Hawks.

Social Media: “We Won’t Let Ditebogo Be Just Another Name”

Public sentiment has been relentless. Hashtags like #JusticeForDitebogo and #EnoughIsEnoughSA trended on X (formerly Twitter) for days after the incident. Many users called for stricter bail laws and more visible policing in high-risk communities. Others expressed frustration with South Africa’s violent crime stats, especially those involving children.

One post read:

“Five years old. Playing outside. Shot in front of his father. This country is failing its children.”

Another echoed the community’s sentiment:

“No bail. No mercy. Let them face the full weight of justice.”

A Bail Bid that Backfired

Moeko, who told the court he runs a hair salon and school transport business, claimed his detention was depriving his children and a deceased brother’s child of support. But that emotional appeal didn’t fly. As Magistrate Khan ruled, he failed to show any exceptional circumstances that could warrant bail.

The case has been postponed to September 10, 2025, and the nation will be watching closely.

A Call for Accountability

As the trial date approaches, Ditebogo’s family, backed by a grieving public, continues to demand accountability. For many, this is no longer just a case about three men and a hijacking gone wrong. It’s become a symbol of broader societal rot—a country where even toddlers can fall victim to greed and gunfire.

Let’s hope the court, and the justice system as a whole, continues to place the dignity of the victim and his family above the desperation of the accused. South Africa owes at least that much to Ditebogo.
