ANC Steps Back From Court Appeal, Leaving Eastern Cape Conference in Limbo

The African National Congress has taken an unexpected step back in its legal battle over the stalled Eastern Cape provincial conference, withdrawing its appeal against a court ruling that halted proceedings last month.

It is a move that shifts the political conversation away from the courtroom and back into the party’s internal processes, but it also leaves uncertainty hanging over one of the ANC’s most influential provinces.

Why The Conference Was Stopped

The 10th Eastern Cape elective conference was brought to a halt after a group of ANC members approached the courts, raising concerns about alleged irregularities in how the gathering was being organised.

The Eastern Cape High Court ruled in their favour, effectively stopping the conference before it could proceed. At the time, the ANC signalled its intention to challenge that decision, setting the stage for a legal showdown.

Instead, the party has now chosen a different route.

ANC Changes Course On Legal Battle

In a formal statement, ANC spokesperson Mahlengi Bengu confirmed that the party, along with Secretary-General Fikile Mbalula, has withdrawn its application for leave to appeal.

The decision follows the release of the judge’s detailed reasons for the initial ruling. According to the ANC, its legal team advised that the matter would be better handled through other court processes rather than pursuing an appeal.

The party believes these alternative avenues will give it the opportunity to present a fuller case, including evidence that its membership systems and administrative processes in the province are in line with its constitution.

What Happens Next For The Eastern Cape

While the legal wrangling continues behind the scenes, the political machinery in the province has not ground to a halt.

ANC Deputy Secretary-General Nomvula Mokonyane has insisted that the Provincial Executive Committee remains intact and fully operational.

She explained that within ANC structures, a PEC is not dissolved until a properly constituted conference sits and adopts its credentials. Since that has not yet happened in the Eastern Cape, the current leadership continues to function as normal.

A Province That Matters

The Eastern Cape has long been one of the ANC’s strongest political bases, producing key leaders and playing a decisive role in national party dynamics. Any delay or disruption to its conference process tends to ripple far beyond provincial borders.

This latest development highlights ongoing tensions within the party around internal governance, membership verification, and conference readiness. These issues have surfaced repeatedly in different provinces over the years, often ending up in courtrooms.

A Strategic Pause Or A Setback

By stepping away from the appeal, the ANC appears to be choosing a more measured legal strategy rather than risking a prolonged court battle with uncertain outcomes.

At the same time, the decision underscores the challenges the party faces in managing internal disputes while maintaining credibility with both members and the public.

For now, the Eastern Cape conference remains on hold, the PEC stays in place, and the next chapter will likely unfold in court through a different legal route.
