Court papers allege Julius Malema colluded with Crime Intelligence boss Feroz Khan

Newly released court papers filed at the Madlanga Commission allege a covert relationship between Economic Freedom Fighters (EFF) leader Julius Malema and Crime Intelligence head Maj-Gen. Feroz Khan, including efforts to remove a senior intelligence watchdog and the sharing of confidential police information.

Allegations set out in investigator’s affidavit

The claims appear in an affidavit by Tshepo Nyatlo, an investigator for the Madlanga Commission, the inquiry examining alleged misconduct in crime intelligence and law-enforcement structures.

According to the affidavit, the papers allege there was a 2021 effort to remove then Inspector-General of Intelligence Isaac Dintwe. The affidavit states that Khan enlisted Malema’s help and, through an intermediary, supplied questions for the EFF to ask in Parliament. Investigators say the questions were designed to trap Dintwe and undermine his position.

Alleged sharing of confidential information

The court papers also allege that Khan shared confidential police information with Malema during the same period. The information is said to have related to a criminal complaint linked to the VBS Mutual Bank scandal and to have included the complainant’s identity and home address.

Public statements and legal status

The allegations contrast with Malema’s previous public statements. The EFF leader has described Khan as a “longtime acquaintance from their ANC days” and has denied any wrongdoing in their relationship.

Neither allegation has been tested in court and no findings have been made against either man, the court papers note.

What comes next at the commission

The revelations come ahead of Khan’s scheduled appearance before the Madlanga Commission on 1 July. The inquiry has reserved multiple days for his testimony.

Investigations by the commission are ongoing and the matters set out in the affidavit form part of its wider examination of conduct within crime intelligence and related law-enforcement structures.
