Randburg Court Case: Couple Accused of Child Pornography and Money Laundering

The case against Darren Wilken and his girlfriend, accused of manufacturing and distributing child pornography, is set to resume today at the Randburg Magistrate’s Court, north of Johannesburg.

Serious Charges and Legal Dispute

The couple faces multiple charges, including:

  • 24 counts of money laundering
  • Possession and distribution of child pornography
  • Contravention of the Drug Trafficking Act

The case was postponed last week due to a dispute over whether the offences should be classified under Schedule One or Schedule Five of the Criminal Procedure Act.

According to National Prosecuting Authority (NPA) spokesperson Phindi Mjonondwane, the defence insists the charges fall under Schedule One, while the State argues they belong under Schedule Five.

“The State has requested a postponement for the Office of the Director of Public Prosecutions (DPP) to provide a certificate confirming the schedule classification,” said Mjonondwane.

Additionally, prosecutors are verifying the address of one of the accused before proceeding.

With the NPA pushing for a higher classification, the case could take a more severe legal route if the court agrees that the offences fall under Schedule Five, which carries harsher bail conditions and potential sentencing.

More details are expected to emerge as the trial resumes.
