Brown Mogotsi denied bail as magistrate cites flight risk and linked firearm evidence
Political fixer Oupa Brown Mogotsi was denied bail on 4 June 2026 and will remain in custody pending his trial, a Johannesburg magistrate ruled after the state argued he posed a flight risk and linked ballistic evidence to other serious crimes.
Background of the case
The matter relates to a shooting in Vosloorus on 3 November 2025, when Mogotsi’s Chevrolet was hit by multiple bullets. Authorities have alleged the shooting may have been staged. Mogotsi was arrested on 15 May in Pretoria shortly after appearing before the Madlanga commission.
Charges and court findings
Mogotsi faces multiple charges, including defeating the ends of justice, perjury, unlawful possession of a firearm and ammunition, and discharging a firearm in a built-up area. The magistrate described the case against him as “overwhelming,” saying ballistic evidence linked a missing 9mm firearm to other murder and attempted murder cases.
“The cartridges that were found at the scene of the crime at Vosloorus are linked to other serious cases,” the magistrate said.
Flight risk and address discrepancies
The presiding officer highlighted difficulties investigators had obtaining a statement from Mogotsi and said he had provided three addresses that did not match one another. The magistrate rejected the defence explanation that a landlord had written a wrong address on a lease.
“The applicant has failed to prove before this court that he has a proper address. The court cannot accept the applicant’s version that it is an error by the landlord to write a wrong address in the lease agreement.”
On these grounds the magistrate found there was a likelihood Mogotsi would evade trial and ordered him to remain in custody.
“The interest of justice does not permit his release.”
Next steps
The matter has been postponed to 12 June so the state can provide the defence with the case docket and to set a trial date.
Madlanga commission allegations
Beyond the shooting, Mogotsi has been implicated at the Madlanga commission. He has been accused of acting as an intermediary between Police Minister Senzo Mchunu who is on special leave and tenderpreneur Vusimuzi “Cat” Matlala. Those allegations were first publicly raised by KwaZulu-Natal police commissioner Nhlanhla Mkhwanazi in July 2025.
Mogotsi previously told the Madlanga commission he was working as a Crime Intelligence contact agent. Evidence presented at the commission challenged that claim, although it was confirmed he had briefly served as an informant in 2001.
