‘Charge Them With Premeditated Murder’: Creecy’s Hardline Stance on Drunk Drivers

Transport Minister Barbara Creecy wants to punish drunk drivers in South Africa to the fullest extent allowable by law.

At the start of the year, Creecy called for a zero-tolerance approach to drunk driversanything above 0% blood alcohol should see arrest and prosecution. That led to an outcry from the restaurant and bar industry, who said such law changes would shut their doors.

Now, the minister has created yet another stir ahead of the Easter long weekend with her views on how to punish drunk drivers.

She believes anyone who causes the death of another should be charged with premeditated murder which carries a mandatory minimum sentence of life imprisonment under the Criminal Law Amendment Act.

The Minister’s View

This week, Creecy addressed the National Economic Development and Labour Council (NEDLAC) in Pretoria.

“85% of people in trauma units are over the legal blood alcohol limit. I believe if someone drinks, gets behind the wheel of a car and causes an accident in which people die, they should be charged with premeditated murder.”

Despite her heightened call, Creecy did say law enforcement measures are working. Increased roadblocks and visible policing have reduced road fatalities by 10% so far in 2026.

“It is a known fact that even a small amount of alcohol diminishes your ability to act, which is why we want to take a zero-tolerance approach to drunk driving.”

The Reality

The majority of fatal accidents occur at night, over weekends, involving alcoholwhen law enforcement officers are not as visible. The department is considering a flexi-shift system to address this.

“One life lost is one too many. Perhaps the prospect of life imprisonment just might serve as a proper deterrent,” said the minister.

The Legal Hurdle

However, legal experts explain that the minister’s plan is not so cut and dried.

To prove premeditated murder, the prosecution must show the death was planned and deliberate. Consumption of alcohol before climbing behind the wheel would not suffice in a court of law.

In most cases of inebriation, the defence could argue the accused lacked the “capacity of direct intent to murder” precisely because of an intoxicated mental state.

The Bottom Line

Creecy wants life sentences for drunk drivers who kill. She says it’s premeditated.

Legal experts say the law doesn’t work that way.

The debate is fierce. The Easter roads are waiting. And the minister’s zero-tolerance push is far from over.
