Healthcare Funders Slam Motsoaledi for Pushing NHI Regulations Amid Court Battles

The Board of Healthcare Funders (BHF) has condemned Health Minister Aaron Motsoaledi’s decision to publish draft regulations for the National Health Insurance (NHI) Act, despite multiple legal challenges against its implementation.
This week, the BHF’s legal challenge against the Department of Health was heard in the North Gauteng High Court in Pretoria. The organisation is seeking a court review to overturn President Cyril Ramaphosa’s decision to sign the controversial bill into law.
Beyond the BHF’s legal action, various political groups have also taken the fight to court, arguing that the NHI Act raises significant constitutional concerns.
BHF managing director Katlego Mothudi expressed disappointment over the government’s decision to push forward with the NHI regulations without meaningful collaboration with the private healthcare sector.
“This brings into question the government’s intent and recent pronouncements on collaboration. Instead of working with the private healthcare sector to find sustainable ways to address the country’s urgent healthcare needs, they have forged ahead with the implementation of the highly contested NHI Act,” Mothudi said.
He confirmed that the BHF is currently reviewing the published regulations and will make a detailed submission in response.
With multiple legal challenges underway and growing concerns from both the private healthcare sector and political parties, the future of the NHI remains uncertain. Critics argue that the government’s unilateral approach risks further instability in an already fragile healthcare system, while supporters claim the policy is essential for equitable healthcare access.
As the legal battles unfold, the question remains—will the NHI survive its mounting opposition, or is it destined to be struck down in court?
