MK keeps ConCourt challenge alive as IEC talks stall

Jacob Zuma’s uMkhonto weSizwe (MK) party has kept a Constitutional Court challenge to the 2024 election results alive, even as talks with the Electoral Commission of South Africa (IEC) have failed to break the impasse, the party said.

Legal challenge moved from Electoral Court to ConCourt

MK originally challenged the 2024 election results in the Electoral Court, asking the court to declare the results null and void on the basis of alleged widespread fraud and mismanagement. The IEC denied those allegations, and MK withdrew its Electoral Court case without giving reasons before taking the matter to the Constitutional Court.

Talks with the IEC appear deadlocked

MK has continued to engage the IEC while pursuing the ConCourt application. The party and the IEC held a meeting last week, but the discussions appeared to have deadlocked on the question of the court challenge.

MK says the legal route is necessary

MK national spokesperson Nhlamulo Ndhlela said the party would press ahead with the Constitutional Court application. He was quoted as saying the ConCourt bid was not a political manoeuvre but a necessary step to protect the electorate’s will.

“Our Constitutional Court application is not a political manoeuvre, but a necessary step to safeguard the will of the people,” Nhlamulo Ndhlela said.

Where MK stands politically

In the 2024 elections MK emerged as the third-largest party in the country, behind the Democratic Alliance and the African National Congress, which retained the top position though it lost its parliamentary majority.

What MK wants from the ConCourt

MK has asked the Constitutional Court to set aside the 2024 election results, citing unresolved concerns about the credibility of the vote. The IEC has denied the vote-rigging and mismanagement claims made by the party.
