It began like any other evening in a quiet Brakpan street. A family returning home, children still in the car, and the familiar routine of opening the gate before heading inside.

What happened next, according to newly surfaced court documents, has left South Africans shaken.

The charge sheet against former police officer Matipandile Sotheni does not just outline a murder case. It paints a deeply unsettling picture of planning, precision, and a moment of violence that unfolded in front of a family who had no time to react.

A moment that changed everything

Marius van der Merwe, known publicly as Witness D, had just stepped out of his vehicle to open his gate on the evening of 5 December. His wife and two young children remained inside the car, waiting.

Within moments, shots rang out.

The alleged gunman fired from a vehicle, striking van der Merwe as his family watched from only a few metres away. He collapsed in the driveway, fatally wounded.

What stands out in the charge sheet is just how close the rest of the family came to sharing the same fate. Prosecutors say the shooting has resulted in not only a murder charge but also three counts of attempted murder linked to his wife and children, who were inside the car at the time.

Alleged planning behind the scenes

According to the state’s version of events, this was no spontaneous act.

Sotheni, a former member of the police’s elite Special Task Force who left the service in 2019, is accused of working with others to carry out the killing. Among those mentioned is Wiandré Pretorius, who has since died.

The charge sheet alleges that van der Merwe was targeted shortly after giving testimony at the Madlanga Commission, where he implicated several individuals in a separate murder case dating back to 2022.

Investigators believe the accused did not know van der Merwe personally. Instead, he was allegedly taken to the Brakpan home and shown the location before beginning surveillance in the days leading up to the attack.

By the time the family returned home that evening, the alleged shooter was already waiting nearby.

A weapon, a plan and a narrow escape

The state claims an AK-47 rifle was specifically obtained for the killing. The weapon has not yet been recovered.

The manner of the attack has also drawn attention. Firing from a moving or stationary vehicle, with deadly accuracy, points to a level of training that few possess.

Police have since confirmed that Sotheni had been highly trained, with significant resources invested in his development during his time in the force.

His arrest months later reportedly led to the discovery of a large quantity of ammunition, for which he allegedly had no legal permit.

Public reaction and deeper concerns

The details emerging from court have sparked widespread concern, particularly around the safety of whistleblowers and witnesses in high-profile cases.

On social media, many South Africans have questioned whether enough is being done to protect individuals who come forward with sensitive information. Others have pointed to the troubling optics of a former elite officer now facing such serious allegations.

There is also growing unease about the broader implications. If the state’s case holds, it suggests a level of coordination and intent that goes beyond a single act of violence.

Sotheni has made his first appearance in court, with the matter postponed to allow for further proceedings. Authorities have indicated that another suspect is still being sought.

For van der Merwe’s family, the legal process will unfold against the backdrop of a loss that happened in the most intimate and traumatic way possible, right outside their home, in front of their eyes.

For the country, the case raises difficult questions about accountability, protection, and trust in institutions meant to serve and protect.
