A South African man has been arrested in Grady County, Oklahoma, in the United States, and is being held on a $500,000 bond in a case involving the alleged possession and sharing of sexually explicit images of children.

Vico DuToit faces nine charges: eight counts of possessing child sexual abuse material and one count alleging that he violated state law through the use of a computer. The case was reported after his arrest in Oklahoma, with a court appearance expected in November.

What the charges allege

Court documents state that the investigation began after authorities received three separate cyber tips. Such tips can alert law enforcement to suspected online activity involving child sexual abuse material and may lead to the collection and examination of digital evidence.

Investigators allege that DuToit possessed, shared and posted multiple sexually explicit images involving children. The allegations form the basis of the eight possession charges and the additional charge connected to the alleged use of a computer.

The source report also states that DuToit reportedly admitted to the allegations when questioned by investigators. He allegedly acknowledged that he knew his actions were wrong.

Any statement made during an investigation remains part of the evidence considered in the legal process. The charges still have to be tested through the courts.

Bond set at $500,000

DuToit is being held on a $500,000 bond, which is approximately R8.3 million. A bond is a financial condition that may be imposed while a criminal case proceeds. It is intended to set terms for a person’s release before trial, subject to the court’s decision and any conditions attached to it.

The bond amount does not determine whether an accused person is guilty. The court process will consider the charges, the evidence and any arguments made by the prosecution and defence.

Next court appearance expected in November

DuToit is expected to appear in court in November. The available information does not state the precise date of that appearance or indicate how the case may proceed after the hearing.

At that stage, the court process may address the charges and the conditions under which the case continues. Further proceedings may also determine how the allegations are dealt with in court.

Why the allegations are serious

Cases involving alleged child sexual abuse material are treated as serious because they concern the exploitation of children and the circulation of abusive material. The alleged possession, sharing or posting of such images can expose victims to continuing harm, as digital material can be copied and redistributed.

Investigations into online offences often involve digital devices, online accounts and records of communications or file transfers. Establishing what happened requires investigators and the courts to assess that evidence alongside the allegations made against the accused.

In this case, the investigation began with cyber tips, while the charges relate to alleged possession and computer use. The court will determine how the case proceeds and whether the allegations are proved.

Presumption of innocence

The allegations against DuToit have not been tested in court. He is presumed innocent unless and until he is found guilty through the legal process.

The reported bond, the pending November appearance and the charges are all part of the case at its current stage. No finding of guilt has been made.
