The Court Case Creating Uncertainty for Millions

The fate of the Social Relief of Distress (SRD) grant offered by the South African Social Security Agency (SASSA) remains undecided as millions of recipients and applicants look to the Supreme Court of Appeal (SCA) for clarity. A legal battle that began in early 2025 is at the heart of this uncertainty, leaving many in limbo while they await a definitive ruling.

The government’s appeal stems from a High Court decision in January 2025, which declared some SASSA SRD regulations unconstitutional and invalid. Issues cited included the online-only application process and a broad definition of ‘income.’ These legal challenges were mounted by advocacy groups such as the Institute for Economic Justice (IEJ) and #PayTheGrants.

What Led to the Supreme Court’s Involvement?

The High Court’s judgment, which criticised the grant’s application framework, prompted the government and SASSA to appeal. Their chief argument was based on sustainability, claiming that the state could not expand provision or eligibility due to budget constraints. The government also stressed that judicial intervention should not dictate allocations from the National Treasury.

Currently, the Supreme Court of Appeal has reserved judgment, with no indication of when a decision will be delivered. The lack of a timeline has added to recipients’ anxiety and uncertainty surrounding future SASSA SRD payments.

Recent and Upcoming Grant Payment Dates

Despite these legal disputes, SASSA has continued to process grant payments. The most recent disbursements took place in October, between the 22nd and 26th.

Although not officially confirmed, November’s payments are likely to occur during the final week of the month, between the 23rd and 27th, based on established precedent.

Possible Outcomes: What Could Happen Next?

As the nation awaits the SCA’s decision, several scenarios are being considered:

  • If the High Court’s order is overturned, current SRD grant rules will remain unchanged. All applications would continue through the online portal and the same procedures for verifying applicants’ income and bank balances would be used. Advocacy groups could seek further relief by appealing to the Constitutional Court.
  • Should the High Court’s ruling be upheld, implementation may face significant delays. The government’s legal team has argued that even four months would be insufficient to enact comprehensive changes and that fiscal constraints remain a major challenge, with the relief cost estimated at approximately R139 billion in additional spending. The government could also appeal to the Constitutional Court if required to comply immediately.
  • There could also be a partial ruling from the SCA. In this outcome, the court might uphold certain findingssuch as amending the definition of ‘income’which could necessitate changes in how SASSA considers sources like lump sum family support or payouts from savings groups (stokvels).

Interim Grant Extension Offers Limited Reprieve

While the legal debate continues, the most recent Medium Term Budget Policy Statement, delivered on 21 October, confirmed that the R370 per month SRD grant will extend for another year, at least until March 2028. This provides some degree of assurance to recipients, though the broader question of ongoing eligibility and program design remains unresolved until the court’s decision is announced.

Potential for Broader Social Policy Reform

This legal battle intersects with a wider public debate over the future of social protection in South Africa. Government discussions about replacing the SRD grant with a permanent Basic Income Support system continue, though details remain unclear and no firm transition plan has been presented.

Any significant changes to the SRD grant, its application requirements, or eligibility criteria would likely have a major impact on millions who rely on the safety net during challenging economic times.

What to Monitor Moving Forward

  • The Supreme Court of Appeal’s final judgment date, and potential for further appeals.
  • Whether the government is granted time to adjust policies or budgets.
  • SASSA’s decisions regarding the online-only application process and income verification methods.
  • Updates about a transition from SRD grants to a more permanent Basic Income Support mechanism.

The situation remains fluid, and millions of South Africans continue to follow developments closely as the nation’s highest courts weigh in on the future of the country’s social safety nets.
