San and Khoi leader found guilty of assault after forcing cyclists off road
The verdict
The case against 47-year-old Wayne Pietersen was finalised in the Humansdorp Magistrate’s Court on 20 May 2026, where he was found guilty of assault with intent to cause grievous bodily harm and common assault.
What happened
The conviction follows an incident on 29 June 2024 in Papiesfontein, within the Sarah Baartman District. Evidence presented to the court showed Pietersen drove a black BMW SUV towards cyclists travelling through a public nature reserve in the Kouga area, forcing them off the roadway.
The National Prosecuting Authority (NPA) spokesperson Luxolo Tyali said Pietersen grabbed one complainant by the arm under the pretext of effecting a citizen’s arrest, then armed himself with a stick (knobkierie) and confronted another complainant, causing injuries when that person fell from his bicycle.
Evidence and testimony
State Prosecutor Siyabulela Swartbooi led evidence from multiple witnesses, including the complainants, an eyewitness and a medical practitioner who compiled the J88 medico-legal report. The court found the State had proven its case beyond a reasonable doubt.
Defence and court findings
Pietersen, who also serves as a Councillor at the Kouga Local Municipality, conducted his own defence and said he believed the cyclists were trespassing on land occupied by members of the Khoisan community and cycling over what he regarded as his forefathers’ graves. He denied the allegations and said the matter was linked to an ongoing land dispute.
The court rejected his version of events. The NPA noted the accused’s actions were not legally justified by cultural or property claims.
Conduct during the trial and next steps
The proceedings experienced delays as Pietersen made several procedural requests, including asking for a Khoisan-speaking interpreter. The court heard he neither spoke nor understood the language. Judges also recorded that his conduct during the trial was frequently disruptive, with repeated interjections, outbursts relating to race and other matters unrelated to the case.
“The court emphasised that legal proceedings are governed by evidence and legal principles and are not a platform for unrelated grievances.”
Following the conviction and before sentencing arguments, Pietersen again displayed disruptive conduct and indicated he was unwilling to proceed. The matter was postponed to 02 June 2026 after he placed an attorney on record.
NPA comment
The NPA reiterated that no person, regardless of position or status, may take the law into their own hands, unlawfully detain individuals, or assault members of the public under the guise of protecting property, cultural claims, or enforcing perceived rights.
