Department of Health Assures ARV Supply Unaffected by High Court Tender Ruling
The Department of Health has assured patients that ARV medication supply will remain consistent despite a recent High Court ruling overturning parts of a major tender.
Understanding the High Court Judgment
The Pretoria High Court, on 20 October, overturned certain allocations in a R15.5 billion ARV medication tender, instructing the Department of Health (DoH) to reallocate these tenders within 120 days. The ruling came after two companies, Cipla Medpro Manufacturing and Hetero Drugs, challenged aspects of the tender’s outcome.
The Disputes and Court Findings
Hetero Drugs, one of the unsuccessful bidders, sought to have its exclusion from the tender awards for Item 13 and Item 23 reviewed. The court dismissed Hetero’s application, upholding the department’s decision regarding their involvement.
Cipla Medpro Manufacturing, however, successfully contested the splitting of awards for Item 13 and Item 23. Both items cover packs of three HIV medicationsdolutegravir, lamivudine, and tenofoviroffered in different quantities (one-month and three-month packs).
Acting Judge Graham Girdwood found that the tenders for Item 13 and Item 23 involved the same medications in differing packs and should not have been awarded as separate items. The court deemed the process unconstitutional and invalid, leading to an order for the department to reallocate the tender awards accordingly.
The Role of Manufacturers and Tender Eligibility
Cipla’s capacity to meet much of the demand was taken into consideration. The court noted that Cipla is a longstanding ARV producer with the ability to supply over half of the estimated demand for Item 13 and nearly half for Item 23 from its KwaZulu-Natal facility.
During the proceedings, two other companiesInnovata and Viatriswere disqualified from future consideration for these specific awards. The judgment pointed out that both firms had participated with expired licences and should have exited the process at the initial stage.
Department Reaffirms Commitment to Patients
In a public statement, the Department of Health welcomed the court’s dismissal of Hetero’s application and reiterated its respect for the legal processes that govern public procurement. The department expressed its commitment to ensuring procurement procedures remain fair, transparent, and legally sound.
The department said it will continue to safeguard the consistent delivery of quality-assured ARVs, prioritising value for money, public trust, and health outcomes for those relying on the public system.
Crucially, authorities confirmed that the judgment poses no immediate threat to the ARV supply chain, with patients assured continued access to their medications. The DoH affirmed ongoing collaboration with provincial departments, depots, and suppliers to achieve seamless distribution during the reallocation period.
What Patients Should Know
No disruptions are expected to the dispensing of ARVs at clinics and hospitals. The department is actively working to maintain stock levels and distribution as it works through the required tender adjustments ordered by the High Court.
- Patients do not need to make any changes to how they receive their medication.
- Healthcare providers will be kept informed of any procedural updates by the department.
- Public health authorities remain focused on uninterrupted treatment for all individuals on ARV regimens.
Maintaining Confidence in the Public Health System
This judgment highlights South Africa’s robust legal oversight in public healthcare procurement. While court decisions can alter supply arrangements, regulatory and departmental safeguards are in place to ensure essential medicines are always accessible to those in need.
The Department of Health’s reassurance comes at a time when reliable access to HIV treatment remains central to public health efforts across the country. Despite the legal and procedural transitions ordered by the court, authorities are steadfast in their message: ARV treatment continuity is protected and patients will remain supported throughout the process.
