The Department of Home Affairs: Public Input Requested for Draft Marriage Bill

The Department of Home Affairs extends an invitation to the public and interested parties to provide written comments on the Draft Marriage Bill of 2022. This draft Bill was officially published in Government Gazette No. 48914 on July 7, 2023 as reported by the South African Government.

Following the approval of the South African Cabinet, the Draft Marriage Bill of 2022 is now open for public comment. Its purpose is to give effect to the White Paper on Marriages in South Africa, which received Cabinet approval in March 2022. The Bill grants the Department of Home Affairs the authority to establish a unified Marriage Act for the country.

The Marriage Bill aims to streamline marriage legislation, ensuring that all individuals, regardless of race, sex, gender, sexual orientation, religious beliefs, or cultural background, are treated with equality and dignity. Public comments are of utmost importance as they will profoundly influence the development of this new legal framework.

In order to facilitate the creation of this unified Marriage Act, the Department has engaged with various stakeholders.

The deadline for written submissions is on or before August 31, 2023. Submissions should be directed to the Chief Director: Legal Services through any of the following means:
